Eligibility: No purchase necessary. Contestants must be 13 years or older. Employees of Darqness Enterprises and those involved in the development, production (including prize suppliers), implementation and distribution of this contest and their advertising or promotion agencies, parent companies, service providers, agents, officers, subsidiaries or affiliates, or any other persons or entities directly associated with this contest (hereinafter "contestants") and members of the immediate families and/or persons living in the same household as such persons, are ineligible to enter. Unless prohibited by law, entry constitutes permission to use winners' names and likenesses in all media by OMGN for publicity purposes without any further compensation. Participation in this contest constitutes contestant's full and unconditional agreement to and acceptance of these Terms of Service. All federal, state and local laws and regulations apply. Void where prohibited. How To Enter: Contestants may enter only once on OMGN's website per contest prize. No electronically reproduced entries permitted. Not responsible for lost, late or misdirected entries, illegible entries or entries containing incorrect information. Complete the information requested on the entry form and then transmit it by clicking on the "Enter Contest" button. All entries must include contestant's email address to be eligible. If there is a dispute about whom the e-mail address belongs to, it will be deemed submitted by the e-mail account holder. If you are under the age of 13, you may not enter a contest. Drawing and Notification: Winners will be selected in a random drawing from all eligible entries received by OMGN, whose decisions are final and binding in all respects. Odds of winning depend on the number of eligible entries received. Winners will be notified by email. If a potential winner cannot be reached or does not respond to the winner notification email within seven (7) business days from OMGN's first attempt to contact him/her, or if he/she is found to be ineligible, or if he/she cannot or does not otherwise comply with these Terms of Service, an alternate winner will be selected by random drawing. All entries become OMGN property and will not be sold or used for additional purposes unless otherwise stated. OMGN will not provide substitution, transfer, or cash equivalent for prizes, except that OMGN and/or Sponsor reserves the right in its sole discretion to substitute any and all prizes with prizes of comparable value. OMGN will make arrangements for the fulfillment of prizes. OMGN is not responsible for lost or damaged prizes. General Conditions and Releases: This is a promotion produced by Darqness Enterprises. All Federal, state and local laws and regulations are applicable. All taxes (including, but not limited to, income taxes) are the sole responsibility of winners. By entering contest or accepting a prize, Winners agree to release OMGN, its parent, subsidiary and affiliated businesses and each of their officers, directors, shareholders, employees, advisors, assignees, agents, licensees, representatives and any other person or entity associated with this contest from any and all liability claims or actions of any kind whatsoever for injuries, damage or losses to persons and property which may be sustained in connection with the receipt, enjoyment, ownership or use of the prize. OMGN and its agents are not responsible for incomplete, lost, late, damaged, illegible or misdirected email; for technical, hardware, or software failures of any kind; for lost or unavailable network connections; or for failed, incomplete, garbled or delayed computer transmissions, which may limit a user's ability to participate in the contest. Contestants agree that OMGN shall not be liable for losses or injuries of any kind resulting from acceptance/possession and/or use/misuse of prize(s), participation in contests, or any technical malfunctions of the telephone network and/or transmission line, computer online system, computer dating mechanism, computer equipment, hardware, software, or any combination thereof, or any entries that are late (including delayed data transmissions), tampered with, garbled, incomplete, misdirected, lost, mutilated, delayed, corrupted, mechanically duplicated, or otherwise not in compliance with these Terms of Service. Contestants also agree that OMGN is not responsible or liable for any injury or damage to an contestant's or third person's computer related to or resulting from the contest and its prizes. OMGN is not liable for damage to a user's computer system in any way due to an contestant's participation in the contest or downloading any information in connection with the contest, including without limitation any server failure, lost, delayed or corrupted data or other malfunction. If, for any reason, the contest is not capable of running as originally planned, such as tampering or infection by computer virus, OMGN at its sole discretion, reserves the right to cancel the contest, without liability. |
